New York Divorce Mediation Intervention

New York divorce mediation is often needed when couples can no longer see eye to eye in their proceedings. Because there are many areas of a marital split that need to be considered, many couples look for a third party arbitrator to handle their proceedings. Even if there is not a lot of issues that need resolution, or the couple has only been married for a few years, many people feel it is best to have someone process through all the separation issues to ensure everything is fair.

There are many couples who decide to call it quits after several years of marriage. Other couples realize they have gone into their marriage prematurely or are not ready to settle down. Still, other couples cannot seem to get along and realize they will be happier apart than together.

There are many things to consider when couples separate. Most couples who have children will have to proceed with custody discussions. If the couple is on good terms and the parting is amicable, then most custody arrangements are easily accepted.

When a couple has moved far beyond the ability to communicate, they need to have an arbitrator intervene to handle their proceeding. Many couples will find that they are arguing over things that are worthless and have no value, however, the animosity between the couple impairs their ability to communicate. Sitting down with a third party to make the process less stressful is important for everyone involved.

Once the children and the property have been discussed, there are other things that need to be factored into a split. Many couples have accumulated a wealth of material possessions and dividing them up may not be easy. Ideally, possessions should be split equally between the two parties; however, that is not always the case. Couples need to remember that they should not argue over things that they do not necessarily want because that will only hinder the proceedings.

Retirements and pensions are the other big items that require negotiation. It seems logical that couples should split everything equally, and in many states, that is how it is done. However, it is not like that everywhere. Many partners do not want to surrender any of their retirement assets and will argue and fight that point relentlessly.

If the couple can work things out on their own without an arbitrator, it is beneficial. However, most couples cannot cooperate and find the discussions too exhausting and stressful. A third party will make sure the proceedings are as stress free as possible and that resolution is quick.

New York divorce mediation is needed when couples can no longer work their separation issues out in an amicable manner. When there is an intercessory party helping to sort out the hard issues that result out of the dissolution of marriage, there is much less strain and suffering. The process may not be easy or painless; however, allowing someone to intervene would get the parties one step closer to resolution.
